By using TykoPass ("we", "us", "the platform"), you agree to be bound by these Terms of Service. Please read them carefully before using our services.

1. Acceptance of Terms

By accessing or using TykoPass, you confirm that you are at least 18 years of age and have the legal authority to enter into this agreement. If you are using the platform on behalf of an organization, you represent that you have the authority to bind that organization to these terms.

2. Description of Service

TykoPass is an online event ticketing platform that allows event organizers to list, promote, and sell tickets to their events, and allows attendees to discover and purchase tickets. We act as a marketplace connecting organizers and attendees.

3. Account Registration

To create events or purchase tickets, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Fees and Payments

TykoPass charges a 3.5% service fee on all paid ticket transactions. This fee is deducted from the proceeds before payout to the organizer. Free events incur no charges. All prices are listed in Kenyan Shillings (KES) unless otherwise stated. Payments are processed through secure third-party payment gateways.

5. Organizer Responsibilities

Event organizers are solely responsible for the accuracy of event information, fulfilment of the event as described, handling attendee refunds per their stated policy, compliance with all applicable laws and regulations, and obtaining all necessary permits and licenses for their events.

6. Attendee Purchases

When you purchase a ticket, you enter into a contract with the event organizer, not TykoPass. TykoPass facilitates the transaction but is not responsible for the event itself. Refunds are subject to the organizer's refund policy as stated on the event page.

7. Prohibited Conduct

You may not use TykoPass to sell counterfeit or fraudulent tickets, engage in unauthorized ticket scalping or resale above face value, post false or misleading event information, violate any applicable laws or regulations, or interfere with the platform's operation.

8. Intellectual Property

TykoPass and its logos, designs, and content are the intellectual property of TykoPass. You may not use our trademarks or copyrighted materials without prior written permission. You retain ownership of content you upload but grant TykoPass a license to display it on the platform.

9. Limitation of Liability

TykoPass is provided "as is" without warranties of any kind. To the fullest extent permitted by law, TykoPass shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the platform. Our total liability shall not exceed the amount of fees paid by you to TykoPass in the 12 months preceding the claim.

10. Changes to Terms

We may update these Terms from time to time. We will notify users of material changes via email or prominent notice on the platform. Continued use of TykoPass after such changes constitutes acceptance of the updated Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Kenya. Any disputes arising shall be subject to the exclusive jurisdiction of the courts of Nairobi, Kenya.
